Non-domiciled CDL rules in 2026
The federal eligibility change, documents to confirm, and the importance of checking your state’s current issuance status.

Federal change effective March 16, 2026
FMCSA’s 2026 final-rule FAQ limits the foreign-domiciled pathway covered by the rule to eligible H-2A, H-2B, and E-2 nonimmigrant status. An employment authorization document by itself is no longer sufficient for that pathway. This is distinct from a standard CDL based on U.S. domicile and from other narrow non-domiciled situations addressed by the rule.
Check documentation and expiration
For the covered foreign-domiciled applicants, the agency verifies a valid foreign passport and qualifying I-94/I-94A documentation through the required process. The credential is limited to the shorter of one year or the authorized admission period. Follow the official FAQ for renewals, transfers, duplicates, and existing credentials; do not assume an old document remains sufficient for a new transaction.
Confirm your state can process the transaction
States unable to comply must pause covered issuance until compliant. Federal eligibility is not a promise that a particular state is currently accepting your transaction. Ask the state which categories it currently processes and what appointment and original documents are required before paying for training.
